Terms and Conditions

I. Definitions

The Data Controller and operator of the website www.birdie.lt (hereinafter referred to as the Data Controller) is “Larinet Solutions Inc, UAB”, company code 302621795, VAT number LT100015479519, registered office at Pramonės g. 97-401, Vilnius, Lithuania, email address – info@birdie.lt.
Buyer – a capable individual or legal entity who has purchased Goods in the online store www.birdie.lt.
The Parties – Buyer and Seller together.
Goods Sales Location – the online store located at www.birdie.lt.
Personal Data – any information relating to an identified or identifiable individual, which can be directly or indirectly identified by means such as personal code, or other attributes such as physical, physiological, psychological, economic, cultural, or social characteristics.
Return Form – a prescribed form which, when filled out, can be used to exercise the right to withdraw from the Goods purchase.
Goods – any products sold in the online store www.birdie.lt, such as golf clubs, bags, trolleys, accessories, clothing, gift cards, etc. In these Terms, the terms “product”, “products” refer to both singular and plural forms.
Goods Purchase-Sale Terms (hereinafter referred to as Terms) regulate the rights and obligations of the Buyer and the Seller, the prices of the Goods, the payment procedure, delivery, quality warranty, returns and exchanges, and liabilities.
Privacy Policy – a document approved by the Seller outlining the main rules for the collection, processing, and storage of Personal Data while using www.birdie.lt.

2. General Provisions

These Goods Purchase-Sale Terms, once confirmed by the Buyer (by reading the Terms and checking the box “I have read and agree to the terms and conditions of the page”), become a binding legal document for the Parties, setting out the Buyer’s and Seller’s rights and obligations, the conditions for purchasing and paying for the Goods, delivery and return procedures, the Parties’ liabilities, and other provisions related to the purchase-sale of Goods in the online store.
The Seller reserves the right to change, correct, or supplement the Terms at any time in accordance with legal requirements.
By confirming the Terms, the Buyer affirms that they have the right to purchase goods in the www.birdie.lt online store.
Also, we inform that these Terms may be changed in case of changes in the legal framework. Each time an order is placed, it is recommended for the Buyer to review the Terms to ensure they fully understand the conditions under which the order will be made.
The Buyer is required to familiarize themselves with the Seller’s approved Privacy Policy. The Buyer expresses consent or disagreement with the specific ways of using their Personal Data as specified in the Privacy Policy.
If the Seller is required to provide documents or information to the Buyer by email, the Buyer is responsible for providing a working and owned email address.

3. Privacy Policy

www.birdie.lt, in conducting electronic commerce, adheres to the Law on the Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation (EU) 2016/679, and other legal acts governing the processing, storage, and implementation of Personal Data.
The Privacy Policy is an integral part of the Terms.

4. Goods

The images of the Goods displayed in the online store are for illustrative purposes. Although the Seller has made every effort to ensure that the colors of the Goods are represented as accurately as possible, the Seller cannot guarantee that the Buyer’s device screen will reflect the exact colors of the Goods. The Buyer understands that the Goods may slightly differ from their images.
The packaging of the Goods may differ from the images displayed in the online store.
All Goods listed in the online store are available to the Buyer. If the ordered Goods are out of stock, the Buyer will be immediately informed by email or other means (phone call and/or SMS), and the order for such Goods will be canceled.
The contract between the Buyer and the Seller is considered concluded at the moment when the Buyer selects the desired Goods, forms a shopping cart, and clicks on the “Order” link, and the Seller contacts the Buyer by phone or email to confirm the order by sending a confirmation email.

Each purchase-sale contract between the Buyer and the Seller is registered and stored in the online store’s database.

6. Buyer’s Rights

The Buyer has the right to review their Personal Data and request corrections of any incorrect, incomplete, or inaccurate Personal Data by sending an email to info@birdie.lt. In this case, the Seller must promptly fulfill the Buyer’s request (within 1-2 business days).
The Buyer has the right to withdraw from the purchase-sale agreement only if the Goods have not been damaged or significantly changed in appearance, have not been used, and remain in their original packaging.
If the Buyer purchases a defective product from the online store, they have the right to request the Seller to ensure the proper quality of the product, reduce the price proportionally, or unilaterally terminate the purchase-sale agreement.
The Seller is responsible to the consumer for any failure of the Goods to meet quality requirements at the time of delivery, which becomes evident no later than two years from the date of delivery of the Goods.

6. Buyer’s Obligations

The Buyer must pay for the Goods and accept them in accordance with these Terms.
If the Buyer’s details change from what was provided on the order form, they must immediately inform the Seller about the changes.
When using the www.birdie.lt online store, the Buyer agrees to comply with these Terms, other conditions clearly specified in the online store, and not to violate the laws of the Republic of Lithuania.

7. Seller’s Rights

The Seller has the right to establish a minimum purchase amount for the Goods in the shopping cart, i.e., the minimum amount for the order to be processed. This amount may be indicated when reviewing the shopping cart.
If the Buyer attempts to harm the stability and security of the online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer’s access to the online store or in exceptional cases, cancel the Buyer’s registration.
In case of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer. In this case, all accepted and confirmed orders will be completed, but no new orders will be accepted.
The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer, choosing payment by bank transfer, does not pay for the Goods.

The Seller may conduct various marketing campaigns and, with prior consent from the Buyers, inform them about these campaigns by sending information to the contact details provided by the Buyers. The Seller also has the right to change the conditions of these marketing campaigns and terminate ongoing campaigns at any time without separate notice.

The Seller undertakes to deliver the Goods to the Buyer within 30 days from the conclusion of the contract. If the Seller cannot deliver the order on time due to important reasons, they must immediately inform the Buyer about the delivery delay.

8. Seller’s Obligations

The Seller must provide the Buyer with the Goods that comply with the terms of the purchase-sale agreement.
The Seller is responsible for ensuring that the Goods are properly packaged and delivered to the Buyer in accordance with the agreed delivery terms.
The Seller must inform the Buyer of any defects in the Goods or delays in the delivery of the Goods.

9. Delivery

The Goods are delivered to the address provided by the Buyer when placing the order. The Buyer is responsible for providing accurate and complete delivery details. The Seller is not responsible for delays or errors in delivery caused by incorrect information provided by the Buyer.

Delivery is carried out by the Seller’s chosen carrier. The delivery cost is indicated when placing an order. Delivery times are estimated and may vary depending on the delivery method chosen by the Buyer.

If the Buyer is not available at the delivery address at the time of delivery, they should inform the Seller in advance to arrange for an alternative delivery time or location.

10. Returns and Exchange

The Buyer has the right to return the Goods purchased from the online store within 14 days from the date of receipt, provided the Goods are not used, and are in their original packaging.
To return Goods, the Buyer must complete the Return Form and send it to the Seller by email at info@birdie.lt. The Seller will provide the Buyer with instructions for returning the Goods. The return shipping costs are the responsibility of the Buyer, unless the Goods are defective or incorrect.
The Goods that were made to order or are sealed and cannot be returned due to health protection or hygiene reasons, are not subject to return.

11. Quality Warranty and Liability

The Seller is responsible for the quality of the Goods and their compliance with the conditions specified in the contract. The Buyer has the right to demand the Seller repair or replace defective Goods, or, if the defect cannot be fixed, demand a proportional reduction in the price or cancel the purchase-sale agreement.
If the Goods are not of satisfactory quality, the Buyer must inform the Seller of the defect within two years from the date of delivery.

The Seller’s liability is limited to the total value of the Goods purchased by the Buyer in the order where the claim was made.

12. Protection of Personal Data

The Seller undertakes to ensure that the Buyer’s Personal Data is collected, processed, and stored in accordance with the applicable data protection laws and regulations. The Privacy Policy outlines the specific ways in which Personal Data is collected and used by the Seller.

By placing an order on the website, the Buyer agrees to the processing of their Personal Data as described in the Privacy Policy.

13. Final Provisions

These Terms and Conditions are governed by the laws of the Republic of Lithuania. Any disputes arising between the Buyer and the Seller shall be resolved by mutual agreement. If an agreement cannot be reached, disputes will be settled by the competent court of Lithuania.

The Buyer confirms that they have read, understood, and agreed to these Terms and Conditions by placing an order with the Seller.
